AI That Respects Patient Privacy

Medical, dental, chiropractic and therapy practices are using AI to answer the phone, draft notes and patient messages, schedule appointments and handle billing questions. Those tools touch protected health information, and HIPAA does not make an exception because the work was done by software. We help practices get the time savings without a privacy incident.

Risks, Rules and How We Help

Where AI risk shows up in a healthcare practice

  • AI scribes, phone agents and chatbots that capture and store patient information with vendors who have not signed a business associate agreement.
  • Staff using free chat tools to draft letters or summarize records, sending PHI to companies with no obligation to protect it.
  • Patient-facing assistants that can be talked into revealing another patient's details or giving clinical advice they should not.
  • Decision support tools whose recommendations nobody has checked for accuracy or bias.

The rules your AI use touches

  • HIPAA Security Rule: AI systems that create, receive, maintain or transmit electronic PHI belong in your required risk analysis and risk management plan.
  • Business associate agreements: any AI vendor handling PHI on your behalf is a business associate and needs a signed BAA before it sees patient data. Many consumer AI tools will not sign one.
  • HIPAA Privacy Rule: the minimum necessary standard limits how much PHI goes into a tool to what the task needs.
  • Breach notification: a leak through an AI tool is a breach like any other, with notice to patients, HHS and sometimes the media.
  • Nondiscrimination in decision support: the Section 1557 rule requires covered entities to make reasonable efforts to identify and reduce discrimination risks in patient care decision support tools, including AI.
